This End User Licence Agreement ("Agreement") is a legal agreement between you ("User", "you" or "your") and RobotPlums ("RobotPlums", "we", "us" or "our"), and governs your use of the RailTerrain software application ("RailTerrain" or the "Software").

By installing, launching or using RailTerrain, you agree to be bound by this Agreement. If you do not agree to these terms, you must not use the Software.

1. Licence

Subject to this Agreement, RobotPlums grants you a limited, non-exclusive, non-transferable licence to install and use RailTerrain for your own lawful purposes.

The Software is licensed, not sold. The developer retains ownership of RailTerrain and all intellectual property rights in the Software except for third-party components, data and materials belonging to others.

2. Permitted Use

You may use RailTerrain to generate terrain-based route files for use with compatible versions of Trainz Railroad Simulator 2022.

Routes created using RailTerrain may be modified, developed and used by you, subject to this Agreement and to any applicable licences or terms governing third-party data, software or assets incorporated into or used in connection with those routes.

This Agreement does not restrict your ability to create, modify or distribute your own original content merely because RailTerrain was used as part of its creation, provided that you comply with applicable third-party licences, attribution requirements and other legal requirements.

3. Restrictions

Except where applicable law expressly permits otherwise, you must not:
- copy, redistribute, sell, rent, lease, sublicense or commercially distribute RailTerrain itself except through an authorised distribution method;

- reverse engineer, decompile, disassemble or otherwise attempt to derive the source code of RailTerrain;

- modify RailTerrain or create derivative versions of the Software for redistribution;

- remove, obscure or alter copyright, trademark or other proprietary notices contained within RailTerrain;

- share, publish, distribute or embed third-party API credentials in violation of the terms of the relevant service;

- use RailTerrain in a manner that is unlawful or infringes the rights of another person or organisation; or

- use the Software or its access to third-party services in a manner intended to overload, disrupt, circumvent or abuse those services.

Nothing in this section limits rights that cannot lawfully be excluded under applicable law.

4. Generated Routes

RailTerrain generates terrain and route files based upon information selected by the user and data obtained from external sources.

RobotPlums does not claim ownership of original creative work that you subsequently add to a route generated using RailTerrain.

The generation of a route by RailTerrain does not transfer to you ownership of any third-party data, intellectual property or other material incorporated into or used to create that route.

You may use, modify and distribute routes generated using RailTerrain for personal or commercial purposes, provided that you comply with applicable third-party licences, attribution requirements and other legal obligations. This permission applies only to rights held by RobotPlums and does not grant, replace or override any rights, permissions or licence terms applying to third-party data or other material used in or associated with a generated route.

RailTerrain generates an attribution file identifying the applicable data sources recorded during generation. If you publicly redistribute a route generated by RailTerrain, the applicable attribution supplied by RailTerrain should be copied into the route description in config.txt, or otherwise displayed prominently with the distributed route.

If you intend to redistribute a generated route commercially, you should review the current licence terms of the data sources identified in the generated attribution file and, where necessary, contact the relevant provider before distribution to confirm any conditions applying to your intended commercial use.

5. Third-Party Data and Services

RailTerrain uses or accesses third-party mapping, elevation, railway and geographical data and online services.
Such data and services remain subject to the licences, terms, attribution requirements and usage policies of their respective providers.

Availability, accuracy, coverage and performance of third-party data and services are outside RobotPlums' control. Providers may change, restrict, suspend or discontinue their services, APIs, datasets or terms without notice to RobotPlums.

RailTerrain generates attribution and provenance information in the generated route folder identifying the data sources recorded as having been used to generate a route. Users who publicly redistribute generated routes are responsible for retaining and reproducing any attribution required by the applicable data providers and licences.

Data-provider terms and attribution requirements may change after a route has been generated. Users intending to redistribute a route should therefore review the current terms of the identified providers before doing so.

6. OpenStreetMap Data

Railway mapping information used by RailTerrain may include data obtained from OpenStreetMap.
OpenStreetMap data is made available under the Open Data Commons Open Database License (ODbL).
Where OpenStreetMap railway data is incorporated into a generated route, RailTerrain includes OpenStreetMap attribution information in the route's generated attribution file.
Where a route or other work containing or derived from OpenStreetMap data is publicly used or distributed, applicable OpenStreetMap attribution and licensing requirements must be observed.

RailTerrain provides suggested attribution wording for convenience. It remains the user's responsibility to ensure that the attribution and other requirements applicable to their particular use are satisfied.

7. Terrain and Elevation Data

Terrain and elevation data used by RailTerrain may originate from different providers according to geographical location, user selection, data availability and the successful completion of data requests.
These sources may include data supplied by or accessed from organisations and services including Natural Resources Wales, the Environment Agency, the U.S. Geological Survey, Geoscience Australia, the Copernicus Programme and OpenTopography.
Individual datasets remain subject to their applicable licences, terms and attribution requirements.

RobotPlums does not sell or claim ownership of third-party elevation data obtained or processed through RailTerrain.
RailTerrain records the terrain source successfully used during route generation and includes corresponding attribution and provenance information in the generated route's RailTerrain_Attribution.txt file.

Where a primary regional terrain source cannot supply the requested data and RailTerrain successfully uses an alternative source, the generated attribution information is based upon the source recorded as actually having supplied the terrain data.

Users who publicly redistribute generated routes should retain the applicable attribution supplied with the route and reproduce it in the route description or otherwise display it prominently with the distributed route.

8. OpenTopography

Certain terrain data may be accessed through services provided by the OpenTopography Facility.

RailTerrain does not provide, embed or distribute a shared OpenTopography personal API key.

Where access to OpenTopography requires an API key, the user must obtain and use their own personal API key and is responsible for complying with OpenTopography's applicable terms, conditions and usage limits.

Data accessed through OpenTopography may be subject to the licence, attribution and other requirements of the underlying dataset provider.
Where OpenTopography services are used to obtain terrain data for a generated route, RailTerrain includes applicable OpenTopography acknowledgement information in the generated attribution file.

9. API Keys and Credentials

RailTerrain may require users to provide personal API credentials for certain third-party services.
API credentials supplied by a user remain the responsibility of that user and must be obtained and used in accordance with the applicable provider's terms.
You must not use API credentials that you are not authorised to use or share, distribute, publish or otherwise disclose credentials contrary to the provider's terms.

RobotPlums does not grant you any rights to access a third-party service beyond those independently granted to you by that service provider.

10. Internet Connection and External Services

RailTerrain requires access to internet-based services for significant parts of its functionality, including obtaining mapping, railway and terrain information.
Previously downloaded terrain information may be cached by RailTerrain, but cached information does not guarantee that the Software can be used fully without an internet connection.

RobotPlums cannot guarantee uninterrupted access to external services or that any particular third-party service, API, server or dataset will remain available indefinitely.
Changes to external services may temporarily or permanently affect some RailTerrain functionality.

11. Accuracy and Intended Use

RailTerrain is intended as a route-building and simulation utility.
Terrain, railway mapping and other geographical information may contain inaccuracies, omissions, differences in resolution, artefacts or outdated information.

Generated terrain and railway guides should not be regarded as authoritative geographical, engineering or surveying information.
RailTerrain must not be relied upon for navigation, surveying, engineering, construction, safety-critical activities or any other purpose requiring certified geographical accuracy.

12. Trainz Railroad Simulator 2022

RailTerrain is an independent utility designed to generate routes for use with Trainz Railroad Simulator 2022.

Trainz Railroad Simulator 2022 is not supplied with RailTerrain and must be obtained separately.

RailTerrain is independently developed by RobotPlums and is not developed, published, endorsed by, or affiliated with N3V Games.
Trainz is a trademark of N3V Games Pty Ltd.

Compatibility with future versions or updates of Trainz Railroad Simulator is not guaranteed unless expressly stated by RobotPlums.

13. Updates and Changes to RailTerrain

RobotPlums may provide updates, fixes, improvements or modifications to RailTerrain.
Updates may alter functionality where reasonably necessary to maintain compatibility, correct faults, improve the Software, comply with legal or licensing requirements, or respond to changes made by third-party services or data providers.

RobotPlums does not guarantee that every feature, external service, API, data source or method of data access will remain available indefinitely.

14. Disclaimer of Warranties

To the maximum extent permitted by applicable law, RobotPlums does not guarantee that RailTerrain will operate without interruption or error or that third-party data and services will always be accurate, complete or available.
Results produced by RailTerrain may vary according to the availability, resolution, quality and accuracy of third-party data.

Nothing in this Agreement excludes or limits any warranty, right or remedy that cannot legally be excluded or limited under applicable consumer law.

15. Limitation of Liability

To the maximum extent permitted by applicable law, RobotPlums will not be liable for indirect, incidental, special or consequential loss arising from the use of, or inability to use, RailTerrain, including loss arising from unavailable, incomplete or inaccurate third-party data or services.

You are responsible for maintaining appropriate backups of routes, projects, source files and other important data.

Nothing in this Agreement excludes or limits liability where such exclusion or limitation is prohibited by law.

16. Steam

Where RailTerrain is obtained through Steam, your use of Steam and your purchase, download, installation and management of RailTerrain through Steam are also subject to the applicable agreements and policies of Valve Corporation and Steam.
Nothing in this Agreement is intended to replace or override rights or obligations that apply between you and Valve in relation to your Steam account, Steam purchases or Steam services.

17. Termination

Your licence to use RailTerrain under this Agreement may terminate if you materially breach this Agreement and fail to remedy that breach where a right to remedy applies.
Upon termination, you must cease using RailTerrain and uninstall the Software, except to the extent applicable law provides otherwise.
Termination of this Agreement does not transfer ownership of your own original route-building work to RobotPlums.
Obligations relating to third-party licences and attribution may continue to apply to material you have already distributed.

18. Governing Law and Consumer Rights

This Agreement is governed by the laws of England and Wales, subject to any mandatory rights and protections available to you under the laws applicable in the country or region in which you live.

Nothing in this Agreement is intended to exclude, restrict or deprive a consumer of any right or remedy that cannot lawfully be excluded or restricted by contract.

19. Changes to This Agreement

RobotPlums may update this Agreement where reasonably necessary, including to reflect changes to RailTerrain, applicable law, licensing requirements or third-party services.
Where required by applicable law, material changes will be communicated appropriately.
Changes to this Agreement will not retrospectively remove rights that have already accrued to you where applicable law prevents this.
